<p><strong>Al Ashriyyah</strong> <strong>P-ISSN: 2776-3129, E-ISSN: 2716-0602</strong> is a blind peer-reviewed, published by Sekolah Tinggi Agama Islam Nurul Iman Bogor, is a peer-reviewed open access international journal published twice in a year (Mei- Oktober). The editors welcome scholars, researchers and practitioners of Islamic Studies around the world to submit scholarly articles to be published in this journal. <p>تُعدّ قاعدة <em>النظر في مآلات الأفعال</em> من المبادئ الأساسية في مقاصد الشريعة، حيث تؤكد على ضرورة النظر إلى نتائج الأفعال وليس فقط إلى مشروعيتها الظاهرة. يهدف هذا البحث إلى تحليل تطبيق هذه القاعدة في <em>مجلة الأحوال الشخصية</em> التونسية، التي تُعتبر من أقدم المدونات القانونية في الدول الإسلامية. يعتمد البحث على المنهج النوعي بأسلوب وصفي تحليلي لدراسة بعض النصوص في <em>مجلة الأحوال الشخصية</em>، والتي تعكس تطبيق هذه القاعدة. وتكشف الدراسة أن عدداً من الأحكام في قانون الأحوال الشخصية التونسي قد قيّدت بعض الأفعال المباحة استنادًا إلى مآلاتها الاجتماعية. ويأتي هذا التوجه متماشياً مع مقاصد الشريعة في تحقيق المصالح ودرء المفاسد. وتؤكد نتائج البحث أن مفهوم <em>النظر في مآلات الأفعال</em> يكتسب أهمية كبيرة في فقه الأحوال الشخصية، خاصة في ظل التغيرات الاجتماعية والقانونية في الدول الإسلامية. ومن خلال إدراك عواقب الأفعال، يمكن للفقه الإسلامي أن يستمر في التطور للحفاظ على التوازن بين نصوص الشريعة ومتطلبات الواقع الاجتماعي</p>Abdul Karim Trabelsi

<p>تبحث هذه الدراسة في ظاهرة فريدة من نوعها في تفسير ابن كثير ، وهي فرض قراءات أصيرة متواطرة على غير عشرة أئمة قرائة مشهورين. تهدف هذه الدراسة إلى تحديد وتحليل ثماني حالات من القراءات التي يؤديها ابن كثير للصحابة أو التابعين، وليس لأئمة القرائة المعروفين في التقليد القرائعي للمتوطير. يستخدم هذا البحث مقاربة وصفية تحليلية وتقنيات توثيق للمصادر الأولية في علم التفسير والقراءات. تظهر نتائج الدراسة أن ابن كثير ، على الرغم من معرفته بأنه مفسر موثوق ، استخدم طريقة سرد لم تتبع دائما النمط القياسي للقراءات العشرة سند. وهذا يدل على مرونة منهج السرد في التقليد الكلاسيكي للتفسير ويبين أن سلطة التفسير يمكن أن تعتمد على نقل الصحابة وتابعين. يفتح هذا البحث مساحة نقاش أوسع للتكامل بين التفسير والقراءات في إطار العلم الكلاسيكي، فضلا عن أهمية النقد والتوثيق السند في دراسة القراءات. وبالتالي، فإن هذه الدراسة تساهم بشكل كبير في فهم ديناميكيات تلاوة القراءات في التفسير الكلاسيكي.</p>Maram Talat Muhammad Amin Yankasar

<p>تتناول هذه الدراسة وتفحص مخطوطة نادرة في مجال أصول الفقه للسيدي بن إسحاق الحميدي (ت 913 ه) ، والتي تناقش تحديدا متطلبات المذهب الحنفي في تحديد وجود العلات (الأسباب الشرعية) بشكل عام قبل إجراء القياسات. تهدف هذه الدراسة من خلال المنهج اللغوي والتحليل التاريخي المفاهيمي إلى الكشف عن إطار التفكير والديناميكيات الداخلية داخل المذهب الحنفي فيما يتعلق بإشكالية القيامة. تتم عملية التحكيم بعناية من خلال الرجوع إلى المخطوطة الأولية ومقارنتها بالأدب الثانوي الموثوق به ، وهي مجهزة بمقدمة تحليلية وسيرة ذاتية موجزة للمؤلف. تظهر نتائج الدراسة أن هناك اختلافات كبيرة في فهم علماء الحنفية فيما يتعلق بمتطلبات العلاة، مما يثير توترات معرفية في إطار عسولية المذهب. تؤكد مساهمة الحميدي على تعقيد وعمق دراسات الشريعة الإسلامية الكلاسيكية التي غالبا ما يتم تجاهلها في الخطاب المعاصر. تسلط هذه النتائج الضوء على أهمية المراجعة النقدية للأدبيات الكلاسيكية من أجل تنشيط طريقة سياقية وسريعة الاستجابة للاستنبات القانونية</p>Fahd bin Mohammed bin Safar al-Mutairi

<p>تبحث هذه الدراسة في استخدام اقتباسات من آيات القرآن والحديث النبوي في منظومة الشاطبية للإمام الشاطبي، وهو عمل ضخم في مجال القراءة. الغرض الرئيسي من هذه الدراسة هو تحديد شكل ووظيفة وقيمة بلاغية لهذه الاقتباسات في بنية نص المنظومة. باستخدام نهج نوعي وأساليب وصفية تحليلية ، يتتبع المؤلف الاقتباسات المتناثرة في مقدمة النص ومحتواه وخاتمه. تظهر نتائج الدراسة أن هناك 28 اقتباسا اختارها السيتيبي بشكل انتقائي، ليس فقط كزخرفة بلاغية، ولكن كوسيلة لتقوية الحجج وترسيخ القيم الروحية وتأكيد الشرعية العلمية. تكشف هذه النتائج أيضا عن وجود منهجيات وإرشادات خاصة في إدراج الاستشهادات التي تظهر الدقة المنهجية والأخلاق العلمية العالية. تعكس هذه القيم التكامل بين علم القراءات والأخلاق القرآنية وروحانية العلماء الكلاسيكيين. تؤكد هذه الدراسة على أهمية التعمق في نصوص المنظومة ، ليس فقط من حيث اللغويات أو القرائات، ولكن أيضا من حيث أبعادها البلاغية واللاهوتية.</p>Iman bint Muhammad ibn Musha'i al-Thabeti

<p>The implementation of Regional Regulations (Perda) with sharia nuances in Indonesia shows a shift in legal functions from regulating public behavior to social engineering based on religious values, especially in forming Islamic family structures. This study aims to analyze the effectiveness of the Marhamah Gate Regional Regulation in Cianjur Regency as a social engineering instrument in the context of a pluralistic society. The method used is qualitative with a legal sociology approach, through case studies, field observations, and in-depth interviews with the community and policy makers. The results of the study show that although this regulation has the symbolic support of the majority of the Muslim community, only a small percentage understand the legal substance in its entirety. In addition, there is resistance from non-Muslim groups and progressive Muslims because they are considered exclusive and non-participatory. This study concludes that the success of local regulations as a social engineering instrument depends on the inclusivity of legislation, the internalization of contextual values, and conformity with the principle of legal pluralism. These findings make a theoretical and practical contribution to the discourse of Islamic law and public policy in multicultural social spaces.</p>Abdul AzizAli Mutakin

<p>Qur'anic exegesis in Saudi Arabia has distinct characteristics compared to other Middle Eastern countries. Although Saudi Arabia is recognized as the center of Islamic civilization and is expected to serve as the epicenter for the development of Qur'anic interpretation, in reality, the progress of tafsir in this country tends to be stagnant. This study aims to analyze the stagnation in the development of Qur'anic exegesis in Saudi Arabia by examining the dominant interpretative trends and the socio-political factors influencing them. The research employs a qualitative method with a library research approach, focusing on various tafsir literatures authored by Saudi scholars and relevant academic studies. The findings reveal that Qur'anic exegesis in Saudi Arabia is predominantly characterized by the <em>tafsir bi al-ma’tsur</em> (transmitted) approach, which is textual and normative in nature, while <em>ijtihad</em>-based and contextual approaches are rarely utilized. Socio-political factors such as the dominance of certain schools of thought, conservative religious education policies, and state control over religious discourse contribute significantly to this stagnation. The study concludes that the stagnation in the development of Qur'anic exegesis in Saudi Arabia is driven by a conservative interpretative orientation, limited openness to modern exegetical methodologies, and the strong influence of socio-political dynamics in shaping the discourse of Qur'anic interpretation in the country.</p>Ghufron Maksum

<p>This study examines the thoughts of Saif al-Dīn al-Āmidī in <em>al-I</em><em>ḥkām fī Uṣūl al-Aḥkām</em>, focusing on his ijtihad methodology to resolve issues related to the waiting period (‘iddah) for women in modern society. Al-Āmidī, a prominent Shafi‘i scholar of usul al-fiqh, developed a systematic methodology of ijtihad through qiyās (analogical reasoning), istidlāl (rational inference), and maqāṣid al-sharī‘ah (objectives of Islamic law). In qiyās, he emphasized the establishment of a valid ‘illah (effective cause) as the basis for legal analogy. His istidlāl approach opened space for legal rationality by considering maslahah mursalah (public interest), ‘urf (custom), and logical reasoning, as long as these do not contradict the maqāṣid of Islamic law. The maqāṣid al-sharī‘ah approach asserts that the primary aims of Islamic law are to preserve religion (dīn), life (nafs), intellect (‘aql), lineage (nasl), and wealth (māl). In the context of ‘iddah, al-Āmidī offers solutions through reinterpretation by taking into account women’s contemporary realities, such as being the main breadwinner or having no possibility of pregnancy due to medical conditions or age. If classical ‘iddah rulings no longer support achieving these five essential objectives, then legal reconstruction based on maqāṣid becomes necessary. The findings indicate that al-Āmidī’s ijtihad methodology provides a strong foundation for contextual reinterpretation of classical fiqh rulings. Qiyās offers a logical-formal instrument, istidlāl provides flexibility to adjust to social realities, and maqāṣid al-sharī‘ah offers moral direction in determining legal validity. Thus, al-Āmidī’s thought is both theoretically relevant and practically applicable as a solution for contemporary ‘iddah issues, being responsive to social dynamics without neglecting authoritative sharia foundations.</p>Dewi Alhaa

<p>This article aims to find an analysis of <em>hamzun</em> verses from the number of <em>hamzun</em> words and their equivalents, subjects, objects, and threats to hamzun practitioners. This research method uses qualitative methods, with a research library style. The method for interpreting verses is the tafsîr <em>maudhû'i</em> method. The findings of this research are that hamzun means an act of making fun of, insulting or cursing to spread other people's gossip, defaming that person's good name without that person's knowledge. Hamzun falls into the hate speech category because he swears by spreading hatred. The word hamzun in the Qur'an is found in 3 (three words), all in plural form, namely: 1. <em>Hamazât</em> means repeated acts of whispering, incitement, reproach, slander, misgivings, and coercion. The perpetrators are humans or demons. The object is poor mukmin who are not lulled by the love of the world. 2. <em>Hammâz</em> means often swearing, backbiting, slandering, lying, unjust. The perpetrator is among humans in general, the object is other people. 3. <em>Humazah</em> means often mocking or swearing. The perpetrators were the Quraisy infidels, the objects were the Messenger of Allah and the believers. The Qur'an describes that the act of <em>hamzun</em> is an act that is very angry with Allah, so that the perpetrators are threatened with extraordinary torture and a drink of pus and blood which they will receive later in the hell of Jahannam.</p>Muhammad Soleh RitongaMuhammad Hariyadi

<p>This study aims to analyze the alignment of the curriculum and learning methods in the Sejarah Kebudayaan Islam MTs Kelas 7 (Islamic Cultural History for 7 Grade MTs) textbook published by the Ministry of Religious Affairs with the standards set in KMA Number 183 of 2019. This research employs a qualitative method with a library research approach, examining the content of the textbook, core competencies, and basic competencies listed. The technique used in this study is content analysis. The analysis results indicate that the textbook covers key topics such as the missionary efforts of Prophet Muhammad (peace be upon him), the advancement of Islamic civilization, and the contributions of Islamic figures, aligning with the curriculum content standards. The learning methods are holistically designed through thematic, contextual, and competency-based approaches, utilizing expository teaching, group discussions, reflection, and project-based research. Although the textbook is effective in fostering active and critical learning, it has some shortcomings, such as a lack of emphasis on the history of Islam's spread in Indonesia and local wisdom, as well as the need for improved visual quality and a more comprehensive glossary. Adding creative methods like simulations and role-playing is recommended to enhance student engagement. With further development, this textbook has the potential to become a more holistic and relevant teaching resource, supporting the achievement of curriculum goals.</p>Dhelta Big Queen Bulqis

<p><em>This article examines in depth the axiological transformation in the legal thought of Mochtar Kusuma Atmadja, especially in the framework of Development Law theory, as well as its relevance to Islamic law reform in Indonesia. In the context of a socially and religiously plural country, a purely legalistic-positivistic legal approach has proven to be insufficiently responsive to the dynamics of society. Atmadja offers a framework of thought in which law is not only understood as a set of rules, but as an instrumental law to drive social change, form collective consciousness, and respond to national challenges substantially. This research uses a normative-philosophical approach with a literature study method that focuses on Atmadja thoughts and Islamic legal theory and practice in Indonesia. The results of the study show that the axiological framework of Atmadja opens up constructive possibilities for Islamic law not to be confined to the rigidity of normative texts, but to be able to transform through a contextual approach that is responsive to the values of maqashid sharia, multicultural reality, and the principles of social justice. It is at this point that Atmadja's thinking is closely in contact with the Islamic law reform agenda, especially in an effort to bridge the gap between sharia norms and the national legal system. Thus, Islamic law is no longer positioned subordinately, but becomes an active part of the development of inclusive, adaptive, and equitable national law. <p><em>The Go-Food service allows users to order food from restaurants using the Go-Jek application. However, opinions on the permissibility of Go-Food transactions vary. Some scholars prohibit this transaction based on the hadith of the Prophet, but other scholars allow it on the grounds of a service rental transaction. However, there are efforts to calm customers but remain within the corridor of sharia. This study aims to examine the differences of several scholars regarding purchasing food through Go-Food. To collect information from various sources and use qualitative data analysis techniques, this study combines a qualitative approach with a literature review. Based on the results of the study, there are differences of opinion on how to interpret the hadith of the Prophet Muhammad SAW regarding the law of transactions due to the practice of ordering food through the Go-Food service. Ustadz Ammi Nur Baits stated that Go-Food transactions are haram because there are two or more contracts in the transaction. However, he emphasized the need for a deeper investigation into the Go-Food transaction procedure. On the other hand, Muhammad Syamsudin assured that Go-Food transactions are valid and permissible, because all parties involved understand the transaction. According to Buya Yahya and Ustad Dr. H. <p>This study explores the legal reasoning (<em>istinbā</em><em>ṭ</em><em> al-</em><em>ḥ</em><em>ukm</em>) methodology developed by Imam Abu Hanifah, one of the founders of the four major Sunni legal schools. The research focuses on his rational and systematic approach to deriving Islamic legal rulings, especially in cases where primary texts (the Qur’an and Sunnah) offer no explicit guidance. Known for prioritizing <em>ra’y</em>, <em>qiyās</em>, <em>istihsān</em>, and <em>‘urf</em>, Imam Abu Hanifah constructed a legal framework that was both rooted in tradition and responsive to the socio-legal realities of Kufa. Utilizing library research and <em>u</em><em>ṣ</em><em>ūl al-fiqh</em> analytical methods, this article examines the structure of his methodology alongside concrete case studies, such as rental contracts (<em>ijārah</em>), fasting exemptions (<em>fidyah</em>) for the elderly, and <em>diyah</em> rulings for pregnant offenders. The findings reveal that Abu Hanifah’s method integrates not only textual sources but also considerations of justice, social needs, and public interest (<em>ma</em><em>ṣ</em><em>la</em><em>ḥ</em><em>ah</em>).
