The childfree phenomenon, referring to the decision not to have children within marriage, has become increasingly prominent in contemporary Muslim societies. This choice is often driven by personal considerations such as lifestyle freedom, economic conditions, or mental health. However, from the perspective of Islamic family law and Maqashid al-Shari'ah, this decision is not merely an individual right, but also relates to social responsibility and the values preserved by the Shari'ah, particularly hifz al-nasl (protection of progeny). This article aims to examine the childfree phenomenon through a Maqashid al-Shari'ah approach in order to assess the extent to which such a decision can be justified within Islamic legal frameworks. The method employed is a library-based normative study, analyzing classical and contemporary fiqh literature as well as maqashidi discourse. The findings indicate that while Islam recognizes individual autonomy in life choices, a permanent decision to remain childfree may conflict with the objectives of the Shari'ah, especially the aim of preserving lineage and ensuring the continuity of the Muslim community. On the other hand, childfree decisions may be conditionally accepted under certain circumstances such as necessity or valid Shari'ah-based reasoning. Therefore, a balanced and proportional approach is needed to evaluate the life choice of being childfree among modern Muslims, reconciling personal rights with broader social and religious responsibilities.
2025-11-16T00:00:00+07:00Copyright (c) 2025 Ahmad Arif Hidayathttps://alashriyyah.stai-nuruliman.ac.id/index.php/alashriyyah/article/view/263Bias Tafsir “Cacat” dalam Pasal 116 Kompilasi Hukum Islam Prespektif Perlindungan Pasangan Disabilitas 2025-11-21T07:37:49+07:00Khusnul Khotimahkhusnulkhotimah.hes@gmail.comGhufron Maksumghufronmaksum@stai-nuruliman.ac.idNur Azizahnurazizah@gmail.com
Divorce based on the ground of “physical disability or an incurable disease” as stipulated in Article 116(e) of the Compilation of Islamic Law potentially produces biased and discriminatory interpretations, particularly when disability is treated as a legitimate reason to terminate a marriage without considering the rights, capacities, and protection of spouses with disabilities. This study aims to analyze the meaning and interpretation of the term disability within the article from the perspective of protecting disabled spouses. The research employs a normative legal approach supported by humanistic and gender perspectives, using document analysis of legal texts, court decisions, and relevant fiqh literature and disability regulations. The findings indicate that the concept of disability in Article 116(e) lacks a clear operational definition, creating opportunities for misinterpretation and discriminatory practices, especially when disability is incorrectly equated with an inability to fulfill marital obligations. The study highlights the necessity of contextual and inclusive reinterpretation to ensure that the provision aligns with the principles of public interest (maṣlaḥah), equality, and the protection of vulnerable groups within Islamic family law. This research contributes to strengthening disability-sensitive legal discourse and provides a foundation for developing fair and non-discriminatory interpretive guidelines for judges in divorce cases involving disabled spouses.
2025-11-16T00:00:00+07:00Copyright (c) 2025 Khusnul Khotimah, Ghufron Maksum, Nur Azizahhttps://alashriyyah.stai-nuruliman.ac.id/index.php/alashriyyah/article/view/273Shalawat dan Implikasinya terhadap Ketenangan Hati dalam al-Qur’an Perspektif Tafsir al-Qurthubi 2025-11-21T07:29:53+07:00Muhammad Waliullahhbmuammadwaliyullah@gmai.com
This research is the result of library research. This research is a library study (library research) using a thematic approach (maudhu’i), by analyzing tafsir books and relevant literature related to the research topic. According to Ar-Razy, the repetition of the verse 31 times represents a form of istifham taqriiri, a rhetorical question intended to emphasize the divine message so that humans and jinn may become aware of and be grateful for Allah’s blessings. Each repetition has its own contextual meaning, depending on the preceding verse—either as a declaration of divine favor or as a warning to deniers. Furthermore, the repetition serves both didactic and reflective purposes in conveying moral and spiritual teachings. The dual pronoun (dhamir mutsanna) in rabbikumā refers to both humans and jinn, and according to some interpreters, it may also refer to men and women, or to believers and non- believers. The results of this study show that Fakhruddin Ar-Razy’s interpretation not only focuses on linguistic aspects, but also reveals the theological and educational dimensions of the repetition in Surah Ar-Rahman.
2025-11-21T00:00:00+07:00Copyright (c) 2025 Ibnu Muktihttps://alashriyyah.stai-nuruliman.ac.id/index.php/alashriyyah/article/view/276Transformasi Hukum Islam dalam Undang-Undang Perkawinan2025-11-21T07:36:07+07:00Mudiono Mudionomudiono89@gmail.comAli Mutakinnabilamandor@gmail.comHeri Sulaimanherisulaiman2511@gmail.com
The transformation of Islamic law within Indonesia’s marriage legislation represents a dynamic interplay between religious values, cultural traditions, and contemporary legal frameworks. This study explores the integration of Islamic principles into national marriage laws amidst socio-cultural shifts and globalization. Employing a qualitative approach through literature analysis and stakeholder interviews, the research highlights significant milestones in the adaptation of Islamic legal doctrines, including the 2019 revision of the minimum marriage age. Findings reveal the dual impact of transformation: advancing gender equality and child protection while facing resistance from traditionalist groups. The paper also examines challenges such as societal resistance and the harmonization of Islamic law with national and international standards. Opportunities for fostering inclusive, adaptive legal frameworks through collaboration between policymakers, religious scholars, and civil society are identified. This study underscores the necessity for a multidimensional strategy to ensure that Islamic law remains relevant in addressing the needs of modern Indonesian society without compromising its foundational values.
2025-10-25T00:00:00+07:00Copyright (c) 2025 Mudiono Mudiono
